STAR Movies Oscars® Quiz

RULES AND REGULATIONS

The following are the rules for “STAR Movies Oscars® Quiz” (“Contest”) which will be held on-air on Star Movies (“Channel”), on Star Movies India Facebook page, on Star Movies website and on-ground as stated hereunder.

Principle Rules

1.      The Contest shall be based on the Oscars® promotion.Star Movies shall conduct a quiz based on Oscar® winning or nominated movies till now.

2.      The Channel shall announce the Contest through on-air promos, on Twitter (www.twitter.com/StarMoviesIndia) and via status update on Star Movies India Facebook page. The Contest shall commence from January 15^th, 2012 at 10.00 hours IST and shall end on the following dates for respective cities on STAR Movies channel (“Channel”) and Star Movies India page on Facebook (“Period”):

Delhi:              27^th January, 2012 at 10.00 hours, IST

Kolkata           2^nd February, 2012 at 10.00 hours, IST

Bangalore:      16^th February, 2012 at 10.00 hours, IST

Mumbai:         16^th February, 2012 at 10.00 hours, IST

3.      The participant may participate in any of the following manner:

(a)   For on-air participation, the participant has to answer a question flashed on the on-air promos, with two (2) options (A or B). The participant(s) has to send an SMS in the following manner: QUIZ <space> A or B (which they think is the right answer) <space> participant’s Full Name to 57827 during the Period .

(b)   For participating via Facebook, the participant(s) need to have a Facebook account at the URL www.facebook.com, login with their Facebook account, visit the Star Movies India Facebook page at www.facebook.com/StarMoviesIndia,  answer a question on the Oscars® tab, and provide their personal details which may include name, mobile number, email address, etc. Entries will be considered null and void if the mandatory personal details are not filled in.

(c)    To Participate in the Contest via Star Movies website , the participant(s) need to visit the website at www.starmovies.in/Oscars, click on the Oscar Quiz tab and answer a question, and provide their personal details which may include name, mobile number, email address, etc. Entries will be considered null and void if the mandatory personal details are not filled in (“Entry(ies)”.

4.      The cost of the SMS shall be solely borne by the viewers. The cost of each SMS shall be charged by the respective telecom/mobile operators at rate stated below:

*BSNL west covers Maharashtra, Gujarat, Chattisgarh, Madhya Pradesh and Goa

5.      In the event, the mobile number (from which the SMS is sent) and/or the Telephone number (given in the online registration form) is not registered in the participant’s name, the participant(s) must submit a NO OBJECTION CERTIFICATE (NOC) from the person in whose name the mobile number or the telephone number is registered to Star India and/or the Channel.  If the participant cannot submit a NOC in the given time, STAR India shall be entitled to forfeit that entry for the Contest.

6.      It shall be deemed that the person in whose name the mobile number is registered (from which the SMS is sent) shall be construed to have sent the Entry(ies) for the Contest. Similarly, for the online registration, person whose name is given in the online form shall be construed to have sent the Entry(ies) for the Contest.

7.      Star India and/or the Channel shall not be responsible for the cost of SMS charged by the respective network provider(s) and /or the internet service provider and shall be borne by the participant(s) alone.

8.      STAR India and/or the Channel shall not be responsible and/or liable in any manner whatsoever for any network problem, breakdown of machinery, unclear network, disruption in the network and/or the cost of the SMS charged by the telecom/mobile operator etc. Any dispute in connection to the above shall be settled between the subscriber(s)/participant(s) and the mobile operator directly, without involving STAR India.

9.      In case of telecom and/or network failure and/or for any reasons whatsoever, STAR India reserves the right to change the entry system/mechanism and/or cease accepting entries of the participant(s) during the Period or take such necessary steps as it may deem fit in its sole and absolute discretion.  

10.  Entries sent after the Period will not be considered for the Contest and shall be deemed null and void.

11.  STAR India and/or the Channel reserve the right to disqualify any participant(s) from participating in the Contest without assigning any reason. The decision of STAR India and/or the Channel in this regard shall be final and binding upon the participant(s).

12.  Star India and/or Channel shall not be responsible or liable for any technical disruption and/or failure/ and/ or any other difficulties of such nature, due to which the participant(s) is unable to participate in the Contest. 

13.  Within 24 hours from the end of the Period mentioned in clause 2, STAR India and/or the Channel will by a process of random selection select forty(40) participants from each of the cities as mentioned in clause 3 who have given correct answer as stated above. Additionally, STAR India and/or the Channel shall by a process of random selection select ten (10) participants from each city who have participated via SMs and who are Vodafone subscribers and have given correct answer as stated above. For sake of clarity, in the event Star India and/or Channel does not find ten (10) participants who are Vodafone subscribers who have given correct answers, Star India and/or Channel may at its discretion may select other participants. Each of the selected participantswill have to bring a companion along for the Quiz(“Quiz Contestants”). The companion must be 18 years and above, a resident of India for them to be eligible for the Quiz. 

14.  Star India and/or Channel shall announce the Quiz Contestants within 24 hours of the end date of each city as mentioned in clause 2 on Star Movies India Facebook page.Also, within 24 hours of the end date of each city as mentioned in clause 2 , each Quiz Contestants will also receive 2 (two) confirmation SMS’s over a span of two days on their registered mobile numbers whichwill have all the details of the Quiz including the details of the venue, date, time etc. 

15.  It shall be construed that the number on which the SMS has been sent is registered in the participant’s name, and that participant only, will be considered as the Quiz Contestant.

16.  The SMS sent to the Quiz Contestants will contain all the details regarding the day, date,time, venue of the Quiz and the. The Quiz Contestants are required to reach the respective venues along with one (1) companionon the following dates:

17.  The Quiz Contestants shall participate in the Oscars® On-Ground Quiz in teams (Quiz Contestant & respective companion) by participating in the following rounds:

·         Preliminary Round:

o   Quiz Contestants need to take a preliminary written examination.

o   Quiz Master Rajeev Masand shall ask approximately 20 questions and Quiz Contestants need to simultaneously write answers on a sheet of paper.

o   These questions shall be based on Oscar®-related trivia.

o   Star India and/or Channel shall announce a half-an-hour break, during which Star India and/or Channel shall check the answers of all Quiz Contestants.

o   The Quiz Contestants with the highest Score in the Preliminary Round shall be selected to come on stage and play the final quiz with Rajeev Masand. Amaximum of4 teams comprising of two (2) participants per team shall be selected for the same. (“Final Quiz Contestants”)

o   In case more than four teams have the same highest score in the preliminary round, a tie-breaker round shall be conducted wherein the Quiz Master shall ask one question and the team to answer it correctly will be qualified.

·         Final Round:

o   Rajeev Masand shall conduct 5roundsof quiz with theFinal Quiz Contestants. The questions shall be based on Oscar® trivia.

o   The team with the highest score atthe end of the Final Round (“Winners”) shall stand a chance to win an iPad2 3G each, the valueof which shall not exceed Rs. 35,000/-(Rupees Thirty Five Thousand Only) each. (“Grand Prize”)

o   The runners-up team (“Runners-up”) shall win an iPod Touch 8GB, the valueof which shall not exceed Rs. 15,000 each/- (Rupees Fifteen Thousand Only) each. (“Prize”)

·         STAR India shall not be responsible to pay for any taxes, duties, charges, license fees, insurance and/or levies applicable under the laws of India, in relation to the Prize and/or Grand Prize and the same, if applicable, shall be solely borne by the Winner(s) and / or Runners-up.

o   The Prize and Grand Prize shall be handed over to the Winners and the Runner-upimmediately after theannounced of the Winners.

18.  STAR India and/or the Channel reserves the right to select the Quiz Contestants and such decision shall be final and binding on the participant(s).

19.  The Quiz Contestants shall be solely responsible for the arrangement of their (including the companion) travel from their place of residence to the Quiz venue and back to the residence and the cost attached thereto.

20.  In the event, the Winner(s) is unable to attend the Oscars® Quiz on the date/time/place communicated by STAR India and/or the Channel or the Oscars® Quiz is cancelled/postponed for whatsoever reasons, STAR India and/or the Channel will not be held responsible and will not be liable to arrange for an alternative Contest.

21.  STAR India/Channel will not be responsible or shall be liable for any defect in the Prize / Grand Prize, if any. 

22.  Neither STAR India and/or Channel nor its employees have given a guarantee regarding the quality of the Prize / Grand Prize and the Winner(s) / Runners-up agree not to hold STAR India and/or the Channel and its employees, responsible with regards thereof. It is clarified that STAR India and / or Channel shall not be responsible for the brand, quality, value etc. in connection to the Prize / Grand Prize and the supplier/ manufacture shall be solely responsible for the same.

23.  By participating in the Contest, it is construed that the participant(s) has read and understood these Principle Rules including the General Rules stated below and has agreed to abide by the same.

General Rules

1.      The viewer(s) interested in participating in the Contest must be above the age of 18 years (as per the Income Tax Act, 1961). The Participant(s) should not have criminal conviction or an arrangement or a contract that prevents the Participant(s) from participating in the Contest.

2.      Proof of age, if requested, of the Participant(s), Quiz Contestant(s) and/or the family members of the Quiz Contestant(s) must be submitted to the Channel and/or STAR India (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).

3.      STAR India reserves all rights to make amendments to the existing rules and regulations or withdraw the Contest without giving prior notice. It shall be the sole responsibility of the viewer(s)/participant(s) to check the rules and regulations of the Contest on the website of STAR India. 

4.      Non-conformance by the Participant(s) to any and all the rules will make such Participant’s entry(ies) null and void.

5.      The Participant(s) shall hold harmless the sponsor, the Channel, STAR India, its affiliates, its group companies, their employees, officers, directors or any other person from and against any injury/damage/harm/loss/ death/ mental or emotional trauma suffered by the Participant(s), in any manner whatsoever in connection with the Contest and/or the Prize / Grand Prize and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India to claim any damages or reliefs.

6.      Employees of and/or consultants of and/or persons hired on contract by STAR India, the Channel, the sponsor and the members of their immediate family are ineligible for participating in the Contest.

7.      By participating it is deemed that the Participant(s) have read, understood, accepted and agree to abide by all the rules and regulations of the Contest.

8.      The Winner(s) and / or Runners-up agree that he/she shall not hold STAR India and/or Channel and/or their employees, responsible for delays or any problem in connection to the Prize and / or Grand Prize. The Winner(s) and / or Runners-up further agree that he/she shall not hold responsible STAR India and/or Channel, in the event, the Winner(s) and / or Runners-up fail to communicate his/her acceptance of the Prize within ninety (90) days from the date of intimation to the Winner(s) and / or Runners-up for reasons whatsoever. In such an event, the Winner(s) and / or Runners-up right to the Prize / Grand Prize shall be forfeited. Further, after forfeiting the Prize / Grand Prize, STAR India and/or the Channel shall be entitled to randomly select and declare another Winner(s) and / or Runners-up, as it deems fit, and award the Prize / Grand Prize, to that Winner(s) and / or Runners-up.

9.      Neither STAR India nor the Channel nor their employees have given any guarantee and/or warranty regarding quality, brand, value, durability etc. of the Prize and/or Grand Prize. Neither STAR India nor the Channel nor their employees shall be responsible and/or liable for any reason whatsoever in connection thereto.

10.  The Winner(s) and / or Runners-up agrees that if due to any reason, whatsoever, beyond the control of the Channel and/or STAR India, the Prize and/or Grand Prize and/or anything in connection to the Prize and/or Grand Prize and/or the enjoyment of the Prize and/or Grand Prize becomes ineffective or invalid, the Channel and/or STAR India cannot be held responsible and/or liable for the same.

11.  The Channel and/or STAR India is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Participants and/or the Quiz Contestants, including the Winner(s) and / or Runners-up in any manner whatsoever or for any reason whatsoever in connection to the Contest and/or Prize and/or Grand Prize.

12.  The Winner(s) and / or Runners-up cannot exchange the Prize and/or Grand Prize for another item or cash equivalent. If the Winner(s) and / or Runners-up refuse to accept the Prize and/or Grand Prize awarded, the Channel and/or STAR India shall be released from all obligations towards the Winner(s) and / or Runners-up in connection to the Prize and / or Grand Prize won by the Winner(s) and / or Runners-up. Further, after forfeiting the Prize and/or Grand Prize, STAR India and/or the Channel shall be entitled to randomly select and declare another Winner(s) and / or Runners-up, as it deems fit, and award the Prize and/or Grand Prize, to that Winner(s) and / or Runners-up. 

13.  STAR India and/or the Channel reserve the right to forfeit the Prize and/or Grand Prize in the event it is found by STAR India and/or the Channel that any information provided by the Participant(s) and/or the Winner(s) and / or Runners-up is wrong, fraudulent or any misrepresentation is made by the Participant(s) and/or the Winner(s) and / or the Runners-up. STAR India or the Channel shall have the right to declare another Participant(s) as the Winner(s) and / or Runners-up of the Contest and transfer the Prize and/or Grand Prize to that person. 

14.  The Winner(s) and / or Runners-up, shall do any and all acts and execute any and all documents in such manner and at such location as may be required by the Channel and/or STAR India in its sole and absolute discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India and/or the Channel herein.

15.  The Winner(s) and / or Runners-up of the Contest agree that he/she shall make himself/herself available from time to time and co-operate with the Channel and/or STAR India and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the Winner(s) and / or Runners-up.  Further, the Winner(s) and / or Runners-up shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Winner(s) and / or Runners-up agrees that the footage of any nature with regard to the Winner(s) and / or Runners-up shall vest with STAR India, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.  

16.  By participating in the Contest, it shall be construed that the Participant(s) and/or the Winner(s) and / or Runners-up has waived his/her right to raise any dispute with regard to the Contest and/or the Prize and / or Grand Prize, in any manner whatsoever.

17.  All and any incidental costs direct and/or indirect, in relation to the Prize and/or Grand Prize, shall be borne by the Winner(s) and / or Runners-up and in no manner whatsoever shall the Channel and/or STAR India, be responsible or liable for the same in any manner whatsoever.

18.  These rules and regulations shall be construed and governed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest and/or the Prize and/or Grand Prize shall be referred to a sole arbitrator appointed by STAR India and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the Participant(s)/ Winner(s) and / or Runners-up who has raised the dispute.

19.  Subject to the provision of Clause 18above, the Courts having jurisdiction under the provisions of the Arbitration and Conciliation Act, 1996, to determine all matters which the Court is entitled to determine under the Act, including, without limitation, provision of interim relief’s under the provisions of Section 9 of the Arbitration and Conciliation Act, 1996, shall exclusively be the courts at Mumbai, India.
