STAR Movies Predict & Win Contest

RULES AND REGULATIONS

The following are the rules for “STAR Movies Predict & Win Contest” (“Contest”) which will be held on-air on Star Movies India (“Channel”),Star Movies India Facebook and Star Movies website as stated hereunder.

Principle Rules

1.      The Contest shall be based on the 84th Academy Awards (“Oscars®”)which will be aired Live on February 27th, 2012, at 06.00 AM Indian Standard Time (“IST”) on the Channel.

2.      The Channel shall announce the Contest through on-air promos, via status update on Star Movies India Facebook page, and on Star Movies India Twitter page. The Contest shall commence from January 27^th, 2012 at 10.00 amIST and shall end on February 27th, 2012 at 10.30 am, IST (“Period”) on Channel and Star Movies India page on Facebook at the URL www.facebook.com/StarMoviesIndia, on Twitter at the URL and www.starmovies.in.

3.      To participate in the Contest, the participants needto Predict Oscar® winners out of the nominations announced by the Academy on 24th January, 2012, on www.oscars.orgon or around 21.00 hours IST for the following categories:

(a) Best Picture,

(b) Best Actor in a Leading Role,

(c)Best Actor in a Supporting Role,

(d) Best Actress in a Leading Role,

(e) Best Actress in a Supporting Role, and

(f) Best Direction.

  i.            To Participate in the Contest via Facebook , the participant(s) need to have a Facebook account at the URL www.facebook.com, login with their Facebook account details , visit the Star Movies India Facebook page, click on the Predict & Win tab,predict from each of the categoriesas stated in clause 3 above on the tab, and provide theirpersonal details which may include name, mailing address, mobile number, email address, and the date of birth (“Entry(ies)”). Entries will be considered null and void if the mandatory personal details are not filled in.

ii.            To Participate in the Contest via Star Movies website, the participant(s) need to visit the website at www.starmovies.in/Oscars, click on the Predict & Win tab and predict from each of the a categories as stated in clause 3 above on the page, and provide personal details which may include name, mailing address, mobile number, email address, and the date of birth (“Entry(ies)”). Entries will be considered null and void if the mandatory personal details are not filled in.

iii.            To complete the Entry(ies), the participant needs to answer the question which will be displayed on-air, during the live screening of the Oscars® on the Channel on February 27^th between 6.00 am and 10.30 am, IST.

iv.            For on-air participation, the participant has to answer a question flashed on- air  in between the live screening of the Oscars® on the Channel on February 27^th between 6.00 am and 10.30 am, IST, with the correct two (2) options (A or B). The participant(s) has to send an SMS  in the following manner :Oscars<space> A or B (which they think is the right answer) <space> participant’s full Name <space> Full Address to 57827 during the Period. Entries will be considered null and void if the full name & address is not mentioned. The Channel shall at its sole discretion run the question during the live screening (“Entry(ies)”).

4.      The cost of the SMS shall be solely borne by the viewers. The cost of each SMS shall be charged by the respective telecom/mobile operators at rate stated below:

*BSNL west covers Maharashtra, Gujarat, Chattisgarh, Madhya Pradesh and Goa

5.      It shall be deemed that the person in whose name the mobile number is registered (from which the SMS is sent) shall be construed to have sent the Entry(ies) for the Contest. Similarly, for participation via Facebook or Star Movies website,the person whose name is given in the online form shall be construed to have sent the entry(ies) for the Contest.

6.      In the event, the mobile number (from which the SMS is sent) and/or the Telephone number (given in the online registration form) is not registered in the participant’s name, the participant(s) must submit a NO OBJECTION CERTIFICATE (NOC) from the person in whose name the mobile number or the telephone number is registered to Star India and/or the Channel.  If the participant cannot submit a NOC in the given time, STAR India shall be entitled to forfeit that entry for the Contest.

7.      Star India and/or the Channel shall not be responsible for the cost of SMS charged by the respective network provider(s) and /or the internet service provider and any such costs shall be borne by the participant(s) alone.

8.      STAR India and/or the Channel shall not be responsible and/or liable in any manner whatsoever for any network problem, breakdown of machinery, unclear network, disruption in the network and/or the cost of the SMS charged by the telecom/mobile operator etc. Any dispute in connection to the above shall be settled between the subscriber(s)/participant(s) and the mobile operator directly, without involving STAR India.

9.      In case of telecom and/or network failure and/or for any reasons whatsoever, STAR India reserves the right to change the entry system/mechanism and/or cease accepting entries of the participant(s) during the Period or take such necessary steps as it may deem fit in its sole and absolute discretion.  

10.  Entries sent after the Period will not be considered for the Contest and shall be deemed null and void.

11.  STAR India and/or the Channel reserve the right to disqualify any participant(s) from participating in the Contest without assigning any reason. The decision of STAR India and/or the Channel in this regard shall be final and binding upon the participant(s).

12.  Star India and/or Channel shall not be responsible or liable for any technical disruption and/or failure/ and/ or any other difficulties of such nature, due to which the participant(s) is unable to participate in the Contest. 

13.  At the end of the Period, STAR India and/or the Channel shall announce 5 winners and 1 grand prize winner.

a.      One (1) participant from amongst the participants who has given the maximum number of correct predictions of the 84^th Academy Award winners in the categories mentioned in clause 4 hereinabove along with the correct answer to the on-air question asked during the LIVE screening of Oscars® (“Grand Prize Winner”).

b.      Two (2) participants from amongst the participants who have given the next maximum number of correct predictions of the 84th Academy Award winners in the categories mentioned in clause 4 hereinabove along with the correct answer to the on-air question asked during the LIVE screening of Oscars® ("Winner").

14.  The Grand Prize Winner shall be eligible to win a fully-sponsored tripto Los Angeles, including return travel in economic class and accommodation for two people for two days-one night at ahotel chosen by Star India and/or Channel, along with bleacher seats to attend the Oscars 2013 for two people (“Grand Prize”), the value of which shall not exceedRs. 200,000/- (Rupees Two Lakh Only).

15.  The two (2) Winners shall be eligible to win 1 (one) Nokia Lumia 800 phones each ("Prize"), the value of which shall not exceed Rs. 30,000/- (Rupees Thirty Thousand Only).

16.  In case more than one participant(s) submit the same number of correct predictions and has answered the questions correctly, the participant who participated first shall be considered as the Winner.

17.  Star India and/or Channel shall announce the Winner on or before 12^th March, 2012, ONLY on Star Movies India Facebook page.

18.  Within 72 (seventy two) hours fromthe close of the Contest, the Winners shall be intimated by the Channel on the Contestant’s registered mobile number and shall be informed that they are eligible for the Prize. The phone call made by the Channel shall have instructions on the further process required to be adhered to by the Winner(s). In the event the Winner(s) fails to adhere to the instructions, that Winner’s selection shall be invalidated and the Channel shall not be liable to that Winner(s) in any manner whatsoever and the Channel at its sole discretion shall select another Winner(s).Star India and/or the Channel shall make a total of two (2) attempts to contact the Winner on their registered mobile numbers. In the event the telephone/mobile number is engaged, or lines on the route are busy, or it is ringing but there is no answer, Channel shall make up to a total of two (2) attempts over two (2) days, i.e. one(1) attempt per day.  In case any Winner(s) is unavailable on both days, the selection of that Winner shall be invalidated and the Channel at its sole discretion may select another Winner.

19.  The Channel shall not be responsible if the Winner(s) is not available at the registered mobile number provided by them and as a result of which, the Winner(s) loses his/ her chance to receive the Prize.

20.  The Winner shall be solely responsible for the arrangement of themselves and their guests’ for any additional travel to and from airport to their hotel / residence and the cost attached thereto. Further, the Winner(s) shall be solely responsible for any and all incidental expenses if any, in relation to the Prize including but not limited to the cost of shopping, food, beverages, etc. ordered and/or consumed by the Winner and the guest during their stay. Further, the Winner shall be solely responsible for any further expenses with respect to extended period in accommodation, over and above the duration of the stay as decided by Star India and/ or the Channel.

21.  The Prize is non-transferrable and non-exchangeable. For the purpose of clarity, no cash equivalent or alternative prize will be given to the Contestant(s) and the Contestants cannot exchange the Prize for a gift of similar value.  Further, the Prize won is personal to the Contestant and the Contestant may not transfer the Prize to any other person.

22.  The Winner must travel on the dates provided by the Channel and such dates are final and not changeable. If the Contestant is unable to travel on such date the Channel reserves the right to invalidate the Contestant and declare another Contestant a Winner. However, the dates are subject to change in the event of some unforeseeable event not in the control of the Channel and the Channel reserves the right to choose another date for travel which it shall communicate to the Contestants.

23.  The Channel reserves the right to choose the hotel accommodation in Los Angeles, at its sole discretion.  In the event the Contestant upgrades himself/ herself, the cost of up-gradation shall be borne by the Participant.

24.  The air carrier shall be at the sole discretion of the Channel to decide and the Contestants shall be travelling economy class. In the event the Contestant upgrades himself/ herself, the cost of up-gradation shall be borne by the Participant. The Channel shall organize the tickets for economy class airfare between the United States and India. In the event the Contestant is accompanied by any companion(s) over & above one guest, all costs in relation to the same shall be borne by the Contestant and the Channel shall not be liable and/or responsible for such costs in any manner whatsoever.

25.  The Channel shall organize the pickup and drop from the airport in Los Angeles to the hotel.  The Winner is solely responsible for travel to and from the Indian airport specified by the Channel. The Winner is responsible for and shall bear any other costs, expenses and charges not specified as being included in the Prize description. For the sake of clarity, the Channel shall not be responsible to pay for the travel insurance and/or any levies applicable under the laws of India or the United States, entertainment costs etc and the same, if applicable, shall be solely borne by the Winner.

26.  The Contestant shall execute any and all documents as may be required by the Channel in its sole and absolute discretion in order to claim the Prize and make travel and stay arrangements.

27.  The Winner and their guest should have a valid passport. In case, the Winner and/or the guest do not have a valid passport, Star India and/or Channel shall select another Winner who has a valid passport.

28.  STAR India and/or the Channel reserves the right to select the Winner of the Contest and such decision shall be final and binding on the participant(s).

29.  During the duration of the Prize, if any loss/damage etc. is caused/incurred, Star India and/ or the Channel shall not be liable for any such loss/damage etc. Further, Star India and/or the Channel shall not be responsible or liable for any change in accommodation and/or flight schedule and/ or any other changes of such nature.

30.  In the event, the Winner is unable to travel on the date/time confirmed by them or the screeningevent is cancelled/postponed for whatsoever reasons, STAR India and/or the Channel will not be held responsible and will not be liable to arrange for an alternative date and/or accommodation.

31.  Neither STAR India and/or Channel nor its employees have given a guarantee regarding the quality of the Prize and the Winner(s) agree not to hold STAR India and/or the Channel and its employees, responsible with regards thereof. It is clarified that STAR India and / or Channel shall not be responsible for the quality, value etc. in connection to the Prize and the supplier shall be solely responsible for the same. 

32.  Any and all taxes and/or levies applicable under the laws of India shall be borne by the Winner in relation to the Prize.

33.  By participating in the Contest, it is construed that the participant(s) has read and understood these Principle Rules including the General Rules stated below and has agreed to abide by the same.

General Rules

1.      The viewer(s) interested in participating in the Contest must be above the age of 18 years and a resident of India (as per the Income Tax Act, 1961). The Participant(s) should not have criminal conviction or an arrangement or a contract that prevents the Participant(s) from participating in the Contest.

2.      Proof of age, if requested, of the Participant(s), Winner(s) and/or the family members of the Winner must be submitted to the Channel and/or STAR India (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).

3.      STAR India reserves all rights to make amendments to the existing rules and regulations or withdraw the Contest without giving prior notice. It shall be the sole responsibility of the viewer(s)/participant(s) to check the rules and regulations of the Contest on the website of STAR India. 

4.      Non-conformance by the Participant(s) to any and all the rules will make such Participant’s Entry(ies) null and void.

5.      The Participant(s) shall hold harmless the sponsor, the Channel, STAR India, its affiliates, its group companies, their employees, officers, directors or any other person from and against any injury/damage/harm/loss/ death/ mental or emotional trauma suffered by the Participant(s), in any manner whatsoever in connection with the Contest and/or the Prize and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India to claim any damages or reliefs.

6.      Employees of and/or consultants of and/or persons hired on contract by STAR India, the Channel, the sponsor and the members of their immediate family are ineligible for participating in the Contest.

7.      By participating it is deemed that the Participant(s) have read, understood, accepted and agree to abide by all the rules and regulations of the Contest.

8.      It shall be deemed that the person in whose name the contest entry is made (from which the message is sent) is construed to have sent the entry(ies) for the Contest.

9.      The Winner(s) have to within ninety (90) days from the date of intimation to the Winner communicate his/her acceptance of the Prize. The Prize shall be delivered to the Winner by STAR India within a reasonable time period after STAR India receives the acceptance of the Prize by the Winner at the address registered with the network operator.

10.  The Winner agrees that he/she shall not hold STAR India and/or Channel and/or their employees, responsible for delays or any problem in connection to the Prize. The Winner further agrees that he/she shall not hold responsible STAR India and/or Channel, in the event, the Winner fails to communicate his/her acceptance of the Prize within ninety (90) days from the date of intimation to the Winner for reasons whatsoever. In such an event, the Winner right to the Prize shall be forfeited. Further, after forfeiting the Prize, STAR India and/or the Channel shall be entitled to randomly select and declare another Winner, as it deems fit, and award the Prize, to that Winner.

11.  STAR India shall not be responsible to pay for any taxes, duties, charges, license fees, insurance and/or levies applicable under the laws of India, in relation to the Prize and the same, if applicable, shall be solely borne by the Winner.

12.  Neither STAR India nor the Channel nor their employees have given any guarantee and/or warranty regarding quality, brand, value, durability etc. of the Prize. Neither STAR India nor the Channel nor their employees shall be responsible and/or liable for any reason whatsoever in connection thereto.

13.  The Winner agrees that if due to any reason, whatsoever, beyond the control of the Channel and/or STAR India, the Prize and/or anything in connection to the Prize and/or the enjoyment of the Prize becomes ineffective or invalid, the Channel and/or STAR India cannot be held responsible and/or liable for the same.

14.  The Channel and/or STAR India is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Participants and/or the Winner in any manner whatsoever or for any reason whatsoever in connection to the Contest and/or Prize.

15.  The Winner cannot exchange the Prize for another item or cash equivalent. If the Winner refuses to accept the Prize awarded, the Channel and/or STAR India shall be released from all obligations towards the Winner in connection to the Prize won by the Winner. Further, after forfeiting the Prize, STAR India and/or the Channel shall be entitled to randomly select and declare another Winner, as it deems fit, and award the Prize, to that Winner. 

16.  STAR India and/or the Channel reserve the right to forfeit the Prize in the event it is found by STAR India and/or the Channel that any information provided by the Participant(s) and/or the Winner is wrong, fraudulent or any misrepresentation is made by the Participant(s) and/or the Winner. STAR India or the Channel shall have the right to declare another Participant(s) as the Winner of the Contest and transfer the Prize to that person. 

17.  The Winner, shall do any and all acts and execute any and all documents in such manner and at such location as may be required by the Channel and/or STAR India in its sole and absolute discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India and/or the Channel herein.

18.  The Winner of the Contest agrees that he/she shall make himself/herself available from time to time and co-operate with the Channel and/or STAR India and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the Winner.  Further, the Winner shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Winner agrees that the footage of any nature with regard to the Winner shall vest with STAR India, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.  

19.  By participating in the Contest, it shall be construed that the Participant(s) and/or the Winner has waived his/her right to raise any dispute with regard to the Contest and/or the Prize, in any manner whatsoever.

20.  All and any incidental costs direct and/or indirect, in relation to the Prize, shall be borne by the Winner and in no manner whatsoever shall the Channel and/or STAR India, be responsible or liable for the same in any manner whatsoever.

21.  These rules and regulations shall be construed and governed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest and/or the Prize shall be referred to a sole arbitrator appointed by STAR India and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the Participant(s)/Winner who has raised the dispute.

22.  Subject to the provision of Clause 21 above, the Courts having jurisdiction under the provisions of the Arbitration and Conciliation Act, 1996, to determine all matters which the Court is entitled to determine under the Act, including, without limitation, provision of interim relief’s under the provisions of Section 9 of the Arbitration and Conciliation Act, 1996, shall exclusively be the courts at Mumbai, India.
